Hi,
I got RFE as PAchai_Attai, the difference is he got NOID.
My attorney has submitted evidences a week ago, still now no updates on my 485.
I have not got tracking # from attorney, he sent email that he submitted evidences. He said he can not check which is my track # used to my case in his office.
He said I have to wait long time to see updates on my case, becuase USCIS is receiving applications in flood.
These Evidences supposed to received by USCIS before Aug 13th. My case is at NSC.
I am in confusion that how to deal this.
Please advise.

well the status quo isn't that bad, is it? Gradually, retrogression will reduce. Now that there is no labor sub, there will be roughly a FIFO system. Plus, no increase in H1B should help the future --- as far as retorgression is concerned. another big plus is that current H1B system is intact. This bill would have driven thousands out of H1B status.
So I say: CIR, RUST in PEACE.

what if person does not get H1 extension approved because of this new employee-employer relationship memo, Can I stay in US on other visa (F2/F1) after H1 extension denial until my priority date become current? Do you see any problem in this option?
If you enter US on a non-immigrant VISA such as F1 or B1/B2, your GC would be considered abandoned.
Well if it is not OK, Go back to India, then apply for AOS once priority date become current. Is this option will work?

I thought you applied under the "Labor Certification" system not PERM. If you did PERM (only then can you file concurrently), nothing stops you from filing for AOS rightaway, so go for it!

As far as I know We need only Employment offer letter. And the Designation should match your PERM Labor Certificate.

but for Employment verification letter, may be not all attorneys asks for it. But most of them ask. And it should have your current H1B/L1 title, if they are asking for this letter.

My wife went for H4 visa stamping in New Delhi embassy yesterday. The visa officer asked her a couple of questions, then asked for my I797 approval notice. He kept the passport and the approval notice and said they will mail the passport with visa.
Do they mail the I797 back with passport? I need the original approval notice for travel and my documentation. Has anyone been through this? Is there a way to follow up with the embassy to get it back? If they lose the document that will be a serious problem.

There are other provisions for "visa recapture" to reduce waiting times and backlogs. This bill would also put a new employment-eligibility-verification system into place. There would be harsh penalties for hiring unauthorized workers.
These proposed changes are very exciting; however, we must remember that this bill is only a PROPOSAL. It will have many reincarnations before a final bill passes, if a bill passes at all.
